1. Overview
These Terms and Conditions apply to all services provided by UNREAL Creative Group Pty Ltd, trading as UNREAL Creative, including real estate photography, videography, floor plan creation, drone and FPV production, social content, brand films and commercial content production.
By engaging UNREAL Creative, confirming a booking, approving a quote, or allowing a shoot to proceed, you agree to the terms outlined below.
2. Bookings & Scheduling
Bookings may be confirmed via email, phone, text message, CRM platform, booking platform, or written proposal approval. No deposits are required to secure standard bookings unless otherwise stated in writing.
Same-day rescheduling or cancellation will incur 100% of the original booking fee. Same-day means the calendar day of the booked shoot or production appointment.
Business hours are 10:00AM to 9:00PM, Monday to Sunday, in the local time zone of the booking unless otherwise agreed in writing. Messages or booking changes sent outside these hours may be treated as received at 10:00AM the next day.
Dawn, twilight, drone, FPV, multi-location and feature-specific shoots may require longer notice due to seasonal timing, light conditions, airspace restrictions, access requirements and crew availability.
3. Turnaround Times
- Photography: delivered within 1 business day.
- Floor plans: delivered within 1 business day.
- Standard videography: delivered within 2 to 3 business days.
Prestige property films, developer brand films, FPV shoots, commercial campaigns, revision rounds, social content packages and multi-property projects follow the timeline agreed in the quote, proposal, or written production schedule.
UNREAL Creative is not liable for delivery delays caused by factors outside our control, including client delays, access issues, missing information, late approvals, platform outages, adverse weather, unsafe conditions, or third-party supplier delays.
4. Weather & Cancellation
UNREAL Creative is not responsible for weather conditions at the time of shoot.
If a shoot needs to be cancelled due to rain or severe weather, the cancellation fee will not apply when the cancellation is made more than 2 hours before the booked shoot time. If a client chooses to cancel or reschedule a booking due to weather within 2 hours of the booking time, the 100% cancellation fee still applies.
Drone, FPV and aerial services are subject to weather, visibility, wind, aircraft safety, CASA rules, property access and local restrictions. UNREAL Creative may refuse or postpone aerial work if conditions are unsafe or non-compliant.
5. Usage Rights & Copyright
UNREAL Creative retains full copyright ownership of all imagery, video, audio, edits, project files and content produced unless otherwise agreed in writing.
Clients are granted non-exclusive, perpetual usage rights for marketing, advertising, listing promotion, social media, presentations and internal business use. Clients may not claim ownership of the content or resell, license, transfer, distribute, or provide the content to third parties for separate commercial use without prior written approval from UNREAL Creative.
UNREAL Creative may use created content for its own portfolio, website, proposals, social media, showreels, advertising and marketing purposes unless agreed otherwise in writing before the booking.
Raw footage, project files, working files and unused takes are not included in standard delivery unless specifically listed in the quote or agreed in writing.
6. On-Site Requirements
Properties must be clean, styled, accessible and ready to shoot at the booked time. Agents, owners, builders, property managers and other representatives are responsible for ensuring access, parking, keys, codes, permits, power, lighting and site readiness.
UNREAL Creative reserves the right to charge additional fees for return visits, delays, overtime, rescheduling, or additional editing caused by unprepared properties, access issues, incomplete styling, unavailable areas, missing instructions, or late changes.
Special requests, including twilight, dusk, sunrise, drone, FPV, floor plans, talent, feature-specific shots, neighbourhood shots, staged scenes, interviews, brand messaging, or social deliverables, must be communicated at the time of booking or before the production schedule is finalised.
UNREAL Creative has the right to refuse entry or stop work at any property or site that feels unsafe, hazardous, unlawful, hostile, or unsuitable for the booked service. It is the agent's, owner's, or client's responsibility to ensure the property is safe to access at the time of appointment. This may trigger a same-day cancellation fee at the discretion of UNREAL Creative.
7. Limitation of Liability
UNREAL Creative will not be held liable for any indirect, incidental, consequential, reputational, commercial, or financial loss arising from the use of its services. This includes missed sales, delayed listings, missed campaign dates, weather-affected outcomes, platform issues, buyer response, agent performance, advertising performance, or third-party decisions.
In the event of a proven service failure directly caused by UNREAL Creative, UNREAL Creative's liability will be limited to the amount paid for the relevant booking.
Nothing in these terms limits rights that cannot be excluded under applicable Australian consumer law.
